These Terms of Use ("Terms") govern your use of the website at lumanan.com (the "Site"), operated by Lumanan, Inc. ("Lumanan", "we", "us"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. The Site is informational
Lumanan is pre-launch. The Site describes a product that is under active development. Descriptions of features, integrations, pricing, and timelines are forward-looking, may change without notice, and do not constitute a binding offer, a warranty of future functionality, or a commitment to release anything on any schedule. Nothing on the Site creates a contract for the provision of any product or service. Any actual product or service we offer will be governed by its own separate agreement.
2. Permitted use
You may view the Site and share links to it for lawful, informational purposes. You agree not to misuse the Site, including by attempting to disrupt it, probing or testing its security without permission, scraping it at abusive volume, or using it to transmit anything unlawful or harmful.
3. Intellectual property
The Site and its contents, including text, design, graphics, logos, and the Lumanan name and mark, are owned by Lumanan or its licensors and are protected by intellectual property laws. Except for viewing and linking as described above, no rights in the Site or its contents are granted to you. You may not copy, modify, distribute, or create derivative works from the Site's contents, or use the Lumanan name or mark, without our prior written permission.
4. Third-party links and services
The Site may reference or link to third-party websites, products, or services, including feature flag and observability vendors named for compatibility context. We do not control them, do not endorse them, and are not responsible for their content, availability, or practices. References to third-party trademarks are for identification only; those marks belong to their respective owners, and no affiliation or endorsement is implied.
5. No warranties
The Site is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that its content is complete, current, or accurate. Statistics and industry figures on the Site are drawn from publicly reported sources and are provided for general context only.
6. Limitation of liability
To the maximum extent permitted by law, Lumanan and its officers, directors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of or inability to use the Site, even if advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability arising out of or related to the Site will not exceed one hundred US dollars ($100). Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.
7. Changes to the Site and these Terms
We may change, suspend, or discontinue any part of the Site at any time. We may also revise these Terms; when we do, we will update the effective date at the top of this page. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
8. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Santa Clara County, California, and you consent to their jurisdiction.
9. General
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver of it. These Terms are the entire agreement between you and Lumanan regarding use of the Site.
